Terms of sale

Purpose

These terms govern the sale of the products offered in the Loanny Beauty online shop. They apply to every order placed on this site and are accepted at the time of ordering. They do not cover treatments carried out at the salon, nor appointments booked through Treatwell.

Products

The shop offers cosmetic products from the brands used at the salon. Each product page states the name, the size or reference where one exists, the description and the price.

Photographs illustrate the product and are not contractual as to shade or packaging, which may change from one manufacturer batch to the next.

Orders are possible within the limits of available stock. If a product becomes unavailable after ordering, we tell you and refund that line within 14 days.

Prices

Prices are shown in euros, all taxes included, Belgian VAT at 21 % included. They exclude delivery costs, which are stated separately before the order is confirmed.

The price applied is the one displayed at the time of ordering. An obvious pricing error does not bind the seller: in that case the order is cancelled and refunded in full.

Ordering

You add products to the cart, choose how to receive them, enter your details, then you are taken to the payment page. The summary shown before payment lists the items, the delivery cost and the total to pay.

The order is firm once payment is confirmed. A confirmation email with the details is sent to you. Until payment is confirmed the order stays pending and no product is reserved.

Payment

Payment is made online through Mollie, a licensed payment provider: Bancontact, card or bank transfer depending on the methods offered at payment time. Payment details are entered at Mollie and never pass through this site.

Products remain the property of Loanny Beauty until the price is paid in full.

Collection and delivery

• Collection at the salon, Avenue de Tervueren 46 in 1040 Etterbeek: free. We email you as soon as the order is ready, and it is held for you for 30 days.
• Shipping within Belgium: €5.95, free from €75 of purchases. The parcel is handed to the carrier within 2 working days, stock permitting.

We do not ship outside Belgium at present. In any event delivery takes place at the latest 30 days after the order; past that, and after a formal notice left unanswered, you may cancel the order and be refunded.

The risk of loss or damage passes to the buyer when the parcel is physically handed over.

Right of withdrawal

As a consumer you have 14 calendar days to withdraw from your purchase, without giving a reason and without penalty. The period runs from the day you take physical possession of the products, or of the last product where the order is delivered in several parts.

To exercise it, send us an unambiguous statement before the period expires, by email to info@loannybeauty.be. You may use the model below, without obligation.

Products are returned or brought back to the salon at the latest 14 days after the statement, in their original condition. Return costs are yours. The refund, including the standard delivery cost, is made within 14 days of receiving the products or proof of their dispatch.

Exception for unsealed products

The right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons, once you have unsealed them after delivery. In practice: a cosmetic whose seal, film or safety cap has been removed can no longer be taken back.

A product still sealed, in its original packaging, is taken back under the usual conditions. Opening the outer box to inspect the product does not lose you that right.

Model withdrawal form

Legal warranty of conformity

Products carry the legal warranty of conformity for two years from delivery. If a delivered product does not match what was described, you may ask for it to be repaired or replaced and, where that proves impossible or disproportionate, for a price reduction or for the sale to be undone.

This warranty adds to the rights you hold under the law and does not limit them. It does not cover damage caused by use contrary to the instructions, nor the expiry of an opened product beyond the period stated on its packaging.

Complaints and mediation

Any complaint should first be sent to the salon, at info@loannybeauty.be. We reply within 7 working days.

Failing agreement, you may contact the Belgian Consumer Mediation Service free of charge, Boulevard du Roi Albert II 8 box 1, 1000 Brussels: consumerombudsman.be.

Personal data

The data collected to process the order is described in our privacy policy.

Applicable law

Belgian law applies. In the event of a dispute the courts of the Brussels judicial district have jurisdiction, without prejudice to the protective rules applicable to consumers, who may always bring proceedings where they live.
